The Three-Member Court of Appeal for Felonies of Larissa found guilty a former inspector of OSE (Hellenic Railways Organisation), two stationmasters and a train driver of Hellenic Train, who were referred to trial in connection with the road accident that occurred at a faulty OSE level crossing in Larissa, when 34-year-old Konstantinos Boubas, while attempting to cross the level crossing in his passenger vehicle, was struck by the train and fatally injured.
The attorney representing the Boubas family and member of the Road Accident legal team of the law firm of Kostas Parìgoris, Ioanna Dakou, stated to “E” that “the verdict represents a significant moment of vindication for the family of the unjustly lost Konstantinos Boubas, only 34 years old. Despite the unspeakable pain of loss, the recognition of responsibilities by Justice sends the message that negligence and indifference do not go unpunished. I would like to note the particularly careful, thorough and fair manner in which the Court examined the case, after 2 postponements, 4 hearings and a full evidentiary procedure. The family feels that the truth was heard and vindicated. However, they believe that the prison sentence imposed should have been served in reality, without the possibility of suspension of execution through the filing of an appeal. We hope that this case will serve as a deterrent so that we do not again mourn human lives at locations where safety should be a given.”
The road accident occurred on the afternoon of 21 June 2022, when at a level crossing (with barriers) next to the school complex of the 7th Junior High School and 13th Senior High School, in the neighbourhood of Agios Georgios, the vehicle driven by the 34-year-old, while crossing the grade-level crossing, was struck by the train operating the route from Volos to Larissa, resulting in his fatal injury. The crossing had warning danger signs; however, due to a malfunction, the barriers (Automatic Level Crossing System – ASID) were not operating.
